2. Repair Requests
Submitting an online repair request does not constitute an agreement for Cloud Hawk Drone Repairs to carry out repair work.
The information provided through the repair request is used to understand the reported fault and determine the appropriate next steps.
We may request additional information, photographs, videos or other details before accepting a repair.
Where appropriate, we may decline a repair request if the equipment is outside our capabilities, parts are unavailable, the repair is considered uneconomical, or for any other reasonable business or technical reason.
3. Sending Equipment to Us
Please do not send your drone or other equipment to Cloud Hawk Drone Repairs without first receiving confirmation or instructions from us.
Equipment sent to us without prior approval may be returned to the sender at the sender’s expense.
You are responsible for ensuring that equipment is packaged securely and appropriately for transport.
Cloud Hawk Drone Repairs is not responsible for damage caused by inadequate packaging or damage occurring during transportation to us.
Where possible, we recommend retaining appropriate shipping documentation and tracking information.
4. Inspection and Diagnosis
Once equipment is received, we may inspect and test it to determine the cause of the reported fault.
A preliminary diagnosis may be provided based on the information supplied by you. A final diagnosis may require physical inspection and testing.
Additional faults or damage may be discovered during the inspection or repair process.
Where additional work is required beyond the originally approved repair, we may contact you for approval before proceeding.
5. Repair Quotes
Where a quotation is provided, the quotation will generally specify the proposed repair work and estimated cost.
Unless otherwise stated, a quotation does not include additional repairs, parts or work that were not identified at the time the quotation was prepared.
Quotes may be subject to change if additional faults or damage are discovered.
We will seek your approval before carrying out significant additional work where reasonably practicable.
A quotation may have an expiry period specified by Cloud Hawk Drone Repairs.
6. Repair Approval
Repair work will generally commence once you have approved the quotation or otherwise authorised us to proceed.
Approval may be provided by email, online communication or another method accepted by Cloud Hawk Drone Repairs.
Once repair work has commenced, cancellation may result in charges for diagnosis, labour, parts or other costs already incurred.
7. Payment
Payment is required in accordance with the payment terms provided with your quotation or invoice.
Unless otherwise agreed, repaired equipment will not be returned until payment for the completed repair and any applicable charges has been received.
Additional charges may apply for:
- Additional repair work approved by you
- Replacement parts
- Shipping
- Return shipping
- Diagnostic or inspection work
- Other costs specifically identified in the quotation or agreed with you
8. Return Shipping
Unless otherwise agreed, you are responsible for the cost of return shipping after your repair has been completed.
Return shipping may be:
- Included in the total amount quoted for the repair; or
- Charged separately before the repaired equipment is returned.
Where return shipping is included in your repair quotation, the amount allocated for shipping will form part of the total amount payable.
Cloud Hawk Drone Repairs may use an appropriate postal or courier service for returning equipment.
Once equipment has been handed to the carrier, delivery times are outside our direct control.
Any loss or damage occurring during return transportation may be subject to the carrier’s terms and applicable Australian consumer law.
9. Customer-Supplied Parts
If you provide parts or components for use in a repair, you are responsible for ensuring that the parts are suitable for the equipment.
We may refuse to install parts that we reasonably consider unsuitable, unsafe, defective or incompatible.
Cloud Hawk Drone Repairs does not provide a warranty for customer-supplied parts.
Additional labour or costs may apply if customer-supplied parts cause installation difficulties, faults or additional repair requirements.
10. Parts Availability
Repair times may depend on the availability of replacement parts.
Some drone parts may be discontinued, unavailable, subject to supply delays or only available from third-party suppliers.
If a required part cannot reasonably be sourced, we may offer an alternative repair solution where available or advise that the repair cannot be completed.
11. Repair Times
We will endeavour to complete repairs within the estimated timeframe provided.
Repair timeframes are estimates only and may be affected by:
- Parts availability
- Shipping delays
- Additional faults discovered during repair
- The complexity of the repair
- Supplier delays
- Testing requirements
- Circumstances outside our reasonable control
We do not guarantee that a repair will be completed within a particular timeframe unless expressly agreed in writing.
12. Repair Warranty
Where a warranty is provided for repair work, the applicable warranty period and conditions will be stated on your repair documentation or invoice.
Unless otherwise stated, the warranty applies to the specific repair work performed and does not necessarily cover unrelated faults or subsequent damage.
Warranty coverage may not apply where a fault results from:
- Crash or impact damage occurring after the repair
- Water or liquid damage
- Improper use
- Further physical damage
- Modification or unauthorised repair
- Incorrect installation or operation
- Use of incompatible components
- Failure to follow manufacturer instructions
- Normal wear and tear
- A separate or unrelated component failure
Nothing in these Terms excludes or limits any consumer guarantee, right or remedy that cannot legally be excluded under Australian Consumer Law.
13. Australian Consumer Law
Our services are provided subject to the rights and protections available to consumers under the Australian Consumer Law (ACL).
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, warranty, right or remedy that cannot legally be excluded, restricted or modified.
Where the ACL applies, you may have rights including guarantees that services will be provided with due care and skill, be reasonably fit for a purpose made known to us, and be provided within a reasonable time where no timeframe has been agreed.
14. Pre-Existing Damage and Faults
We are not responsible for damage, faults or defects that existed before equipment was received by us.
During inspection or repair, we may identify pre-existing damage that was not disclosed in the original repair request.
Where possible, we will document significant pre-existing damage and may provide photographs or other evidence.
15. Data and Personal Information
You are responsible for backing up any data, photographs, flight records or other information stored on equipment before sending it to us.
Repair procedures may require equipment to be reset, updated, reconfigured or otherwise altered.
Cloud Hawk Drone Repairs is not responsible for loss of customer data resulting from a repair where such loss is reasonably necessary to perform the repair or results from the condition or operation of the equipment.
We handle personal information in accordance with our Privacy Policy.
16. Customer Responsibility for Equipment
You confirm that you have the legal right to provide the equipment to Cloud Hawk Drone Repairs for inspection and repair.
You should remove personal belongings or accessories that are not required for the repair unless they are necessary for diagnosis.
Where equipment is provided with accessories, batteries, controllers or other components, we may record those items when the equipment is received.
17. Batteries and Hazardous Equipment
Lithium batteries and other potentially hazardous components must be packaged and transported in accordance with applicable transport requirements.
You are responsible for notifying us of any damaged, swollen, leaking or otherwise potentially hazardous battery before sending it.
We may refuse to accept or transport equipment that presents a safety risk.
18. Testing and Flight Testing
Some repairs may require operational or flight testing to confirm that the repair has been completed successfully.
Where flight testing is reasonably required, testing will be conducted only where appropriate and subject to applicable laws, regulations, safety requirements and operating conditions.
If flight testing is not appropriate or cannot safely be conducted, we may use alternative testing methods.
19. Equipment That Cannot Be Economically Repaired
In some cases, the cost of repairing equipment may exceed its reasonable value or may not be commercially viable.
We may advise you that a repair is uneconomical where the expected repair cost, parts availability, condition of the equipment or other factors make repair impractical.
You may then choose whether to proceed, collect the equipment or arrange return shipping.
20. Unclaimed Equipment
If you do not collect or arrange return of your equipment after we have notified you that the repair is complete, we may contact you to arrange collection or return.
Where equipment remains unclaimed for an extended period, we may take further action in accordance with applicable Australian law.
We will make reasonable attempts to contact you before taking such action.
Reasonable storage, handling or return costs may apply where permitted by law.
21. Limitation of Liability
To the maximum extent permitted by law, Cloud Hawk Drone Repairs will not be liable for indirect, incidental or consequential loss arising from the repair or use of repaired equipment, including loss of income, business interruption or loss of opportunity.
This clause does not exclude or limit liability that cannot legally be excluded or limited under Australian law.
Nothing in these Terms limits your rights under the Australian Consumer Law.
22. Risk in Equipment
Risk in your equipment remains with you except to the extent that Cloud Hawk Drone Repairs is responsible for loss or damage while the equipment is in our possession.
We take reasonable care of equipment while it is in our possession.
You are responsible for arranging appropriate insurance for your equipment where you consider insurance necessary.
23. Intellectual Property
Any diagnostic procedures, repair methods, documentation, photographs, reports or other materials developed by Cloud Hawk Drone Repairs remain our property unless otherwise agreed.
You retain ownership of your equipment and materials that you provide to us.
24. Website Information
We endeavour to ensure that information published on our website is accurate and current.
However, product specifications, repair capabilities, availability, pricing and other information may change without notice.
Website information should not be considered a guarantee that a particular repair, part or service will be available.
25. Changes to These Terms
Cloud Hawk Drone Repairs may update these Terms from time to time.
The latest version will be published on our website and will apply to services accepted after the updated Terms take effect.
The Terms applicable to an existing repair will generally be those accepted when the repair was authorised, unless otherwise required by law.
26. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You and Cloud Hawk Drone Repairs submit to the applicable courts and tribunals of New South Wales, subject to any rights you may have under Australian law.
